Lawyers in mediation – how are they measuring up?
Members who regularly have lawyers present in mediations are invited to email University of NSW PhD candidate John Woodward to arrange a time to discuss their experiences of lawyers and mediation generally.
How do lawyers perform in mediations? Are they zealous advocates for their clients’ cause in a competitive and adversarial way or do they embrace the spirit of principled negotiation positively in a way which seeks value added and lasting outcomes? Do they understand the value of disputant empowerment and participation?
John would love to hear from mediators about their experiences of mediations where lawyers are present and is happy to travel to suburban, regional or rural centres to speak to you.
The aim of the thesis is to establish whether lawyers are taking advantage of the benefits that mediation has to offer or whether mediation is merely another step on the road to court.
