SA Arbitrator Masterclass

Saturday, 23 March 2024 | 8.30am – 4pm Adelaide Time | Piper Alderman |Hybrid (Registration from 8am and masterclass to run from 8.30am| SA based Arbitrators in person, interstate attendees will join virtually).

The Arbitration Masterclass offers an engaging workshop experience, inviting participants to actively contribute to discussions on various topics related to arbitration. Participants will be evaluated based on their contributions and comprehension of the arbitration process.

Participation in a Masterclass and achieving a satisfactory assessment are obligatory prerequisites for re-certification or review of certification as per the Resolution Institute's policy regarding the Register of Practicing Arbitrators.

Under the Resolution Institute Masterclass policy;

All intending Grade 1 and 2 participants are reminded and requested to suggest topics for discussion at the Masterclass no later than Wednesday, 06 March to enable;

  • topics to be grouped and allocated to sessions; 
  • a program for the Masterclass, specifying the topics for each session, with relevant participants nominated to jointly facilitate, to be provided to each participant: and,
  • a copy of final agenda with the assessment criteria and objectives of the Masterclass to be provided to each participant prior to the Masterclass.
Suggestions for topics, questions, or issues should be concise, not exceeding 100 words, and should stem from the registrant's own experiences, known circumstances, or relevant cases and articles. These submissions should be sent to [email protected] on or before Wednesday, 06 March 2024.

Grade 3 Arbitrators may attend subject to sufficient available space.  


Masterclass Lead Facilitator 

Russell Thirgood

Russell Thirgood is an independent international arbitrator, expert determiner and mediator who specialises in complex and high value construction & infrastructure, energy, renewables, natural resources and commercial disputes, practicing out of Brisbane, London and Washington DC.

Prior to becoming a fulltime arbitrator, Russell spent over 23 years at McCullough Robertson Lawyers, where he was head of arbitration and a senior construction law and infrastructure partner.

Russell is experienced in resolving complex and high value commercial disputes. He has conducted cases throughout Australia, the Pacific, Asia, US, UK, Middle-East and Europe, under some of the key international and domestic arbitral institutional rules. He has been appointed by parties jointly and arbitral institutions, including the ICC and ACICA.

Russell is the immediate past Chair of The Resolution Institute (the pre-eminent dispute resolution organisation in Australia and New Zealand) and is a director of the Australian Centre for International Commercial Arbitration.
 

Masterclass Facilitators

Andrew Robertson

Andrew has been involved in the delivery of both arbitration and mediation training programs for IAMA/RI since 2001 including tutoring/coaching at both courses. Lectured/presented on arbitration and mediation at conferences (nationally and internationally) law society CPD and as a component of the SA legal admission program.

Andrew is skilled in achieving client outcomes through mediation, arbitration and other forms of alternative dispute resolution (ADR). He advises clients regarding the advantages and disadvantages on using ADR. Where ADR is used he often appears as counsel on behalf of his clients. Andrew is qualified in mediation and arbitration (domestic and international), was a National Councillor and National Treasurer of the Institute of Arbitrator and Mediators and was the Treasurer of the South Australian Chapter.

He is a founder and past National Chair of the Society of Construction Law Australia. He has advised on various aspects of construction contracts, both front end and back end, and advised on construction adjudication claims in several States.

Lolita Mohyla AM LFRAIA FRI-Arb1

Lolita has been a Partner of Mohyla Architects Interior Designers since 1984, and am a registered Architect in SA, and formerly NSW, Qld & Victoria. For several years she has been Managing Partner of the practice as well as principle client contact for a variety or private and corporate clients. The firm is in Adelaide and is predominantly commercially based. 
In 2007, in response to growing demand for my ADR services (Arbitration, Expert Witness work), she established LVM Group Pty Ltd. LVM Group provides all manner of ADR services, as well as advice on project delivery systems, forms of contract, contract clauses and project management services. She is a Grade 1 Arbitrator, and has undertaken numerous arbitrations, both private and Court-ordered. 
In 2012, She was appointed a permanent Commissioner of the Environment, Resources and Development Court of South Australia, a position she still holds today.
