ASEAN and Investment Treaty Arbitration

Recent years have seen notable developments in both the investment treaty architecture in ASEAN and in investment arbitration jurisprudence involving investors and States from the region. As regards the former, the ASEAN Comprehensive Investment Agreement enhances investment protection alongside a network of bilateral and multilateral investment instruments. In terms of cases, investors from ASEAN States are increasingly using investment treaties to protect their investments and there has been a marked growth in the number of investment treaty arbitrations against ASEAN States. This trajectory looks likely to continue in the years to come.
