Resolution Institute prepares submissions

Review of Security of Payment Laws

Resolution Institute Chief Executive Officer, Fiona Hollier and Growth Coordinator Belinda Cachia recently met John Murray AM who has been appointed by the Commonwealth Government to conduct a nationwide review of security of payment laws in the building and construction industry, in preparation for our response to the review.

Mr Murray will be looking at the state-of-play in each jurisdiction and has already met with Resolution Institute members in Victoria (pictured) and Western Australia.

The terms of reference of the review are summarised as follows:

  • to examine security of payment legislation of all jurisdictions to identify areas of best practice for the construction industry;
  • to consult with business, governments, unions and interested parties and the Security of Payments Working Group;
  • to consider how to prevent various types of contractual clauses that restrict contractors in the construction industry from obtaining payments for work that has been completed.

Adjudicators nationally have been invited to express their views in relation to key areas to inform Resolution Institute's submission to the review.


NSW farm debt mediation act review

The Farm Debt Mediation Act 1994 (NSW) is being reviewed to ensure it continues to deliver on its original intent, and to provide a model for nationally consistent legislation.

The Board of the NSW Rural Assistance Authority, which is overseeing the review, has published a Review Consultation Paper >>
