On the 15th and 16th of July over 400 delegates descended virtually on to the  Resolution Institute 2021 international conference, Resilience and Reinvention: Dispute Resolution During a Crisis. Distinguished guest speakers included Her Excellency the Hon Margaret Beazley AC QC, Governor of NSW and The Hon Michael Kirby AC CMG who delivered the keynote address, titled Wicked Problems. Bright Solutions.

Other speakers appearing at the event included key influencers and stakeholders from the business, government, law, judiciary, commercial and academic sectors.

Peter Voss, a Partner at Ashurst, chaired a panel titled “Energy and Resource Disputes” which featured a broad range of perspectives from throughout the energy sector, from renewables to coal, and where alternative dispute resolution could fit into the picture.

“We heard from a range of participants in the energy and resources industries as to how the transition to sustainable energy and de-carbonisation, together with the resurgent resources boom, were generating issues and challenges requiring the resolution of disputes,” Mr Voss said.

One of the major challenges that has been overcome somewhat recently, Mr Voss went on to say, was the tyranny of distance which often plagued large-scale disputes, both in the litigation and arbitration contexts.  

“Online platforms and dispute resolution allows for ease of access across countries and time zones and reduces the cost of matters significantly as parties do not need to spend time agreeing upon and renting a common venue for dispute resolution to take place,” he said. 

As COVID-19 continues to disrupt the local and global economies, significant challenges are apparent. For both private enterprises and public institutions, priorities are rapidly shifting under increased pressure and for organisations in dispute prone sectors, the efficient resolution of disputes is now more important than ever in order to maintain business and rebuild community confidence and harmony.
