In fond memory of Brian Gallagher
We are sad to let our members know that Brian Gallagher passed away on 20 February 2019 aged 81 years.
Brian had a long and very distinguished career as Arbitrator in Victoria and published over 200 awards. He was Victoria's most prolific Arbitrator and Special Referee. He was extremely well respected for his extraordinary ability to control a hearing room and cut to the nub of an argument. This was no mean feat when the advocates who appeared before him were commonly Silk or went on to be. Brian didn't have any legal qualification. In just one multi-party arbitration he had Counsel before him who are now six Silk, one Supreme Court Judge and one High Court Judge.
He will be remembered for the undaunted respect he showed for all building practitioners: experts, lawyers, other arbitrators and judges, even when he did not agree with their opinions, submissions or decisions.
Brian studied Building Construction at the Royal Melbourne Institute of Technology from 1955 to 1957. After working in the construction industry for ten years he commenced his Building Consultant and Arbitrator practice in 1969. He was on the Council of Management of Master Builders Association of Victoria (1962 - 64), the State Council and then Executive of the Housing Industry Association Victoria (1976 -83) and he was the Foundation President of the Building Dispute Practitioners Society (1979 - 81).
Brian was a and a member of IAMA (now Resolution Institute) from 1976 to 2010 and a member of the Victorian Chapter Committee of IAMA from 1987 to 1995.
He will be missed by all who knew him.
A memorial service will be held for him Friday 1 March 2019, 1 pm, at the Heritage Funeral Home, 733 Boronia Rd Wanterna. Donations in memory of Brian instead of flowers to Eastern Palliative Care in envelopes available.
