Legal considerations for dispute resolvers in the context of COVID (NZ)

We offer this free webinar as part of our ‘responding to change’ series.

This is a panel discussion webinar that offers a conversation to discuss the legal considerations that emerge for dispute resolvers in the context of COVID-19.

This will not be offering advice or directive but a discussion to help build our member agency.

We have asked our panel to bring their thoughts on the following questions:

  • when gathering a group of people as a dispute resolver, what are your obligations to check vaccination status – and if you do, the ramifications? What if you wish to?
  • if an employment mediator, what is emerging in the context of employment mediations where vaccination status is a factor?
  • equally if you are an employer what are your obligations with regard to health and safety?
  • what other legal considerations or ramifications are emerging in your dispute resolution context due to COVID?

We’ll then open to the ‘virtual floor’ and gather any questions or thoughts you have.

Please note we are running this webinar specific to the context in NZ and also in AU. You are of course welcome to attend both, they are both free, but please note this one is specific to the NZ context.

Hayden Wilson
Partner and Mediator,

Hayden Wilson is the Chair of Dentons Kensington Swan and a member of the Dentons Global Board.

With over 20 years’ experience as a litigator and a mediator, Hayden specialises in the resolution of commercial and civil disputes.

His practice also includes complex relationship property, employment and public law disputes.

Sarah Cates
Employment lawyer and mediator
Sarah Cates is an employment lawyer and mediator specialising in workplace issues at Sarah Cates Employment Law based in Wellington.

Sarah advises employers, employees and unions from a range of industries on their legal rights and obligations in respect of contentious and non-contentous employment law matters.

Wi Pere Mita
Lawyer / Mediator

Ngāti Porou, Te Aitanga a Mahaki, Rongowhakaata, Ngāti Maniapoto

Wi Pere is a lawyer / mediator who specializes in Kaupapa Māori dispute resolution.

He is a graduate of the kōhanga reo and kura Māori movements and is an advocate for the advancements of Māori aspirations in law and dispute resolution.

He is a member of the Resolution Institute Board of Directors and Chair of the Kāhui Māori, Resolution Institute Māori Caucus.

Rosaline Fuata’i
Family lawyer and mediator

Rosaline Fuata’I is a Family Court barrister and mediator practicing in Manukau City, Auckland. Of Samoan ethnicity; Samoan is Rosaline’s first language.

Rosaline is a member of the Resolution Institute and since June 2021 has been Co-Chair of the Resolution Institute Pasifika Network.

Rosaline has been involved in family mediations for a number of years. She is an accredited family dispute resolution provider and appears regularly in the Family Court in relation to Care of Children Act 2004, Oranga Tamariki Act 1989, Protection of Personal and Property Rights Act 1988 and Adoption Act 1955 proceedings to represent parties or children, as counsel to assist the court and counsel for subject person.

Rosaline holds warrants as a district inspector under the Mental Health (Compulsory Assessment and Treatment) Act 1992, Intellectual Disability (Compulsory Care and Rehabilitation) Act 2003 and Substance Addiction (Compulsory Assessment and Treatment) Act 2017.

Peter Jackson
Chief Mediator | Tumuaki Kaihohourongo

Peter has worked for HRC for almost 7 years, with the last two as Chief Mediator.

He leads HRC’s Dispute Resolution Team, and has 26 years’ experience in several dispute resolution organisations.

A large part of this has been in operational management/leadership roles, whilst maintaining a small amount of work as a practitioner.
