This interactive seminar is suitable for all types of disputes that may require a mediation session and is designed to provide practical tips. This presentation will include:
- How to get the best from a mediator/mediation session- pre mediation and during the mediation session;
- Practical tips for solicitors when preparing for/attending mediation sessions;
- Dealing with emotions, including aggressive behaviour, during mediation sessions;
- Common pitfalls, including discussion of a mediator's "war stories" and some recent case law on relevant issues;
- Recent developments in mediation; and
- Question time.
About the Presenter
John is a commercial litigator and mediator with over 34 years’ experience. He has practiced in a large city firm, a mid size firm, a small boutique city practice and since mid-2017 as a sole practitioner. John has been a member of the ADR Committee of the Law Society of NSW. His litigation practice has exposed him to a very wide range of dispute matters, including, but not limited to: Corporations Act, shareholder/director disputes, trade practices, consumer law, commercial and general lines insurance, residential and commercial construction, insolvency, intellectual property, contracts, general and professional negligence, franchising, wills and estates, employment contract breaches, finance and securities, specific performance, property disputes and, in his early practise days, personal injury and dust diseases claims. John also has experience advising clients regarding Fair Trading, ASIC and ACCC investigations.
John has been an accredited mediator since the early 1990’s and Nationally Accredited since that scheme was introduced. He is on a number of mediator Panels: Resolution Institute, Law Society, Franchising and Horticulture Codes. His mediation practice has involved a very wide range of dispute matters in most, if not all of, the areas described above. John has presented seminars on mediation related topics to lawyers, accountants and insurers in Australia and Canada. His recent article on Online Mediation has been published in a number of publications.
