CPD event | Online | Security of Payments Unleashed. Look out Mums and Dads!

On 1 March 2021 the NSW Building and Construction Industry Security of Payment Act was amended to include disputes involving owner occupiers.

For the first time in NSW residential building payment disputes where the principal lives in (or intends to) will be subject to the provisions of the Act.

This session will discuss the changes in the Act that apply to residential buildings and the possible impact on Mums and Dads having new homes built and carrying out renovations. The possible disputes will be regarding work that the owners often have a deep personal interest and may be taken by surprise by these changes to the Act.

The presenters are experienced adjudicators and will bring adjudicators and legal professionals up to date with the recent changes and their implications.

About the presenters

Philip Martin

Philip Martin has over 40 years experience as a civil and structural engineer and holds degrees in Engineering and Law. He has undertaken the design and construction of numerous projects ranging from roads and bridges to high and low rise buildings. He provides expert reports and expert determinations on building and construction problems and defects. He is an experienced arbitrator and over the last 20 years has adjudicated disputes under the Security of Payment legislation in all states except WA and NT.

Robert Riddell

With 32 years’ experience in property and construction legal practice, Robert has been recognised as a highly recommended construction lawyer in The Legal 500 Asia Pacific 2018. Robert’s experience extends to projects and developments in Australia and PNG, having been managing partner of Gadens (as it was then known) PNG office in 2011 and 2012. Robert has been an accredited SOP adjudicator since 2003, having recently delivered his 50th determination. Robert sits on the MBA's Legal and Contracts Committee and is the Chair of the Resolution Institute’s Sydney Determinative Professional Development Group.

Graeme Robinson

Graeme has 40 years experience in major mineral resource project development including scoping, feasibility stages, commercial, execution and design development, detail engineering, construction, commercial management and dispute resolution as an arbitrator, adjudicator and mediator. In the last 25 years Graeme has filled senior executive roles on several multi billion-dollar resource and infrastructure projects. Graeme has also developed several residential and commercial projects in Australia. He has developed and completed multi million dollar projects buildings, mines and ports in Australia, Asia, Africa, the Middle East, and the Pacific rim filling senior management roles for owners, contractors, consultants and financial institutions on project delivery. Graeme undertakes dispute resolution on such projects in all these locations, specialising in the more challenging international locations.
