In response to ADRAC's 2021 Report, "Conciliation: Connecting the Dots", Resolution Institute has compiled a specialised course in Conciliation theory, skills and practice.

This workshop provides the skills and knowledge to assist those who work in any statutory or industry scheme conciliation process. The skills are not only relevant to conciliators but all those involved in the process including managers, intake staff and lawyers.

Who is this training for?

  • Conciliators (or aspiring conciliators) and mediators who work within a statutory body or other government agency/association/ authority with a specific jurisdictional or legal focus.
  • Mediators who have completed the five-day Resolution Institute mediation training
  • Those practicing the skillset such as managers, intake staff and lawyer

What will you learn?

The learning goals include:

  • Understanding the theory and practice of conciliation, as distinct from mediation and other dispute resolution processes
  • Clarity as to what a good conciliation process looks like and the guiding principles for a conciliator
  • Understanding the role, responsibilities, and limitations of a conciliator
  • An overview of legislative foundations of conciliation (non-industry specific)
  • Conciliation models of practice and key conciliation skills and practice based on relevant roleplays
  • Expert knowledge and the application of administrative law and other general legal principles
  • Advocacy, authority, reporting requirements and ethical practice
  • Practice in some of the key, distinct conciliator skills including specialised opening statements and managing expectations around jurisdiction and relevance.

Are there any prerequisites?

Either:

Being an accredited mediator or

Working knowledge of mediation/conciliation/conferencing

Assessment

There will be a short assessment which includes comprehensive and personalised feedback for each participant from our trainers. Participants will be asked to complete a written reflection on how they apply conciliation skills in their work. Our trainers will also provide each participant with feedback on their reflective writing, understanding of core concepts and demonstration of key skills during the live workshop.


About the presenters

Shiv Martin

Shiv is a nationally accredited mediator, lawyer, statutory decision maker and certified trainer. She has engaged in complex dispute resolution in the government and legal sectors for over 10 years. As a trainer, Shiv has a unique and diverse set of expertise in Law, Management, Adult Education and Mediation.

Shiv is currently an Assistant Information Commissioner, Queensland. In this role she makes statutory decisions on the information and privacy rights of individuals, corporations and government entities. Shiv also runs her own practice, Integrative Conversations and conducts private mediations and conflict resolution training.

As a Conference Registrar for the Administrative Appeals Tribunal, Shiv conducted conferences and conciliations in a broad array of public sector disputes including tax, worker’s compensation and disability support (NDIS matters) and social services complaints.

As an experienced community mediator, Shiv has a keen interest and skill in conducting cross-cultural and intergenerational mediations. She is an active member of the South Queensland Dispute Resolution Centre where she continues to train, coach and assess aspiring mediators for Mediator Accreditation.

Shiv’s greatest area of strength and passion is training and coaching in dispute resolution. She has taught students of the University of Queensland and Newcastle University. She has also trained many public service decision makers in negotiation skills and strategy.

Shiv also advises organisations on designing and implementing appropriate policies, systems and practices around effective conflict resolution and complaints handling. Most recently, Shiv has partnered with MODRON in introducing and supporting dispute resolution practitioners in transitioning to online dispute resolution platforms.

Alexandra Sidoti

Alexandra has extensive experience in dispute resolution. Having commenced her career as a solicitor in commercial litigation, Alexandra has spent 15 years working in alternative dispute resolution within the financial services industry. She has worked as a case manager/investigator, a practising conciliator and as a decision maker.


Alexandra has a particular interest in dispute resolution practice and processes. She completed her masters honours thesis on role and boundaries of advice in conciliation practice at the Financial Ombudsman Service. She has a long history of providing dispute resolution training and conciliation coaching both internally and externally with stakeholders in the financial services industry.

In recent years she was instrumental in developing and implementing an internal training and ccreditation programme for conciliators at the Australian Financial Complaints Authority, and its predecessor scheme the Financial Ombudsman Service. This is a structured programme that includes preliminary training, conciliation observation and coaching and a series of micro skills modules.

  • How do I access the Online Workshop?

    You will receive the Zoom link in your registration confirmation email.

  • What do I need on my computer or device to take part in an Online Workshop?

    You will ideally need a computer or device with a camera and microphone and good Internet coverage. You will need to make sure that you can access ‘Zoom’ in your browser. You can download and install Zoom prior or as part of the process when you first click the Zoom link.
