Mediator, facilitator and conflict consultant.
I have been a mediator since 1996 and a teacher of mediation (at Monash University and elsewhere) since 2001.
My mediation practice draws from the facilitative, transformative and narrative streams of practice. I am comfortable mediating any matters in which specialist technical knowledge is not required. I have developed particular expertise in workplace grievances, bullying & harassment, and in working with religious & community organisations experiencing conflict. I have also worked with First Nations groups in a range of roles.
I have a sliding scale of fees depending on the situation of the client. See http://www.shawnwhelan.com.au for further information about me and my work.

In 40 years experience of international construction experience I developed profitable consultancy businesses in Australia, Europe, the Middle East and South East Asia. I help clients to resolve their disputes by investigating the best ADR process (or processes) to use in their particular circumstances. I'm a strategic thinker, an empathetic listener and solution driven.
Karen StottSydney, Regional NSW, Tasmania
My litigation background includes health, professional & government liability and workplace relations.
I have practised full time as a Mediator since 2016 because of a genuine commitment to alternate dispute resolution. I was included by Doyle's Guide to the Australian Legal Profession in its inaugural list of Leading Mediators NSW in 2018 and again in 2019 & 2020.
My approach is to be hands on: to prepare thoroughly, engage with the legal reps beforehand, genuine focus on the parties on the day, and offer to follow up if the matter doesn’t settle. I believe that’s what a mediator should do.
My Mediation and ADR practice includes:
- Medical negligence Mediations and facilitation of expert witness joint conferences
- Other personal injury matters - motor accidents, work injuries, occupier & vicarious liability
- Historic institutional carer abuse claims
- Commercial matters (re disputes over sums up to $1M)
- Court-appointed mediator to the ACT Magistrates Court
My legal background:
For the first 10 years of my career I acted for injured plaintiffs, including the establishment of a successful medical negligence practice in 2000 operating on a contingent basis and without recourse to advertising.
From 2007, I acted at partnership and consultant level in 2 Sydney CBD mid tier law firms for 6+ years, representing various state government departments and commercial insurers in areas such as education, police, roads, health, occupier’s liability and professional liability.
I then acted for approx 150 insulation industry clients in the 2014 Home Insulation Program Royal Commission. This led to high level consultation with Ministers of the Commonwealth regarding a payment scheme, sourcing of litigation funding and finally: to the launching of a class action against the Cth, in Aug 2016.
What I love about Mediation is the ability to achieve a cost effective resolution on best terms for all parties - and to address some of the key drivers of the conflict in a way that just isn't possible in Court. And I am a big believer in the importance of good preparation by the mediator and the parties. It always gets the best results.
