Adaptive Mediation provides services to assist parties in dispute to identify options and negotiate agreement, focussing on their needs and interests.
Mediation is a confidential and cost effective method of alternative dispute resolution. The process allows parties to express their concerns and feel heard in safe environment, and encourages them to explore the underlying issues for a deeper, shared understanding of the other parties’ position in order to find appropriate solutions.
Mediators do not provide either party with legal advice. Their role is to impartially facilitate discussion and exploration of the issues, and party-led generation of options for negotiation and resolution. The decision making power remains in the hands of the parties. This ensures the parties are empowered to formulate more creative solutions than if a third party or judicial officer makes the decision for them.
There are several types of mediation. Adaptive Mediation focuses on the Facilitative Model, but applies other techniques if appropriate throughout the course of the mediation.
The Facilitative model is a fairly structured but flexible process which applies across many areas of law – community disputes, contract and commercial disputes, employment / organisational issues, partnership/business law disputes, family law and so on. It focuses on needs and interests, rather than the legal rights and obligations, of the parties.
Jonathon (John) Keenan is a Registered Liquidator and Principal with BRI Ferrier, a national practice specialising in corporate restructuring for businesses in both growth or distress situations. John has over 20 years’ commercial, professional and restructuring experience.
John specialises in corporate recovery and business restructuring, where he regularly is brought in to advise boards in difficult circumstances, and is also appointed to take control of businesses through formal appointments such as Voluntary Administration, Receiverships and Liquidation.
