Expression of Interest (EOI) for our Natural Hazard Dispute Resolution Services

Fair Way is the provider of the Dispute Resolution Scheme (NHCover Dispute Resolution) provided for the Natural Hazards Commission under the Natural Hazards Insurance Act 2023 which came into force on 1 July 2024.

Fair Way is running an Expression of Interest process to supplement our existing NHCover panel, and to set up an additional panel for those disputes where an insurer dispute has been joined.

Dispute Resolution Scheme
Under the Natural Hazards Insurance Act 2023 (the Act) the Natural Hazards Commission Toka Tu Ake (the Commission) is required to be a member of a dispute resolution scheme (Scheme) approved by the Minister for resolving disputes about the Commission’s decisions on the validity or settlement of claims (Sections 59 and 60 of the Act). The sections of the Act relevant to the dispute resolution scheme are sections 101 to 107.

While the Commission and insurance providers have internal complaints processes available to homeowners, it is important that homeowners also have access to trusted, external services for disputes that are not resolved internally.

The Scheme is based on the principles of accessibility, independence, fairness, accountability, efficiency and effectiveness and will provide for two types of dispute resolution processes: mediation and adjudication.

Key Points

  • Mediators and Adjudicators will be independent and professional, being contracted through Fair Way.
  • Mediation may be done face-to-face, and mediators may need to travel. Mediation may also be done online, on a case-by-case basis, if deemed appropriate by both parties, although the clear preference is for face-to-face mediation wherever possible. Adjudication will not include a hearing unless there are exceptional reasons requiring this.
  • Fair Way is seeking a diverse panel of practitioners for mediation and/ or adjudication appointments. This includes demographic and geographic diversity as well as experience working with people from a variety of backgrounds. Knowledge of and experience in the area of insurance is beneficial for all practitioners.

  • Has current and relevant mediation, adjudication and/or legal accreditation and experience
  • or holds membership with Resolution Institute, AMINZ or NZLS
